Capretz & Associates is investigating claims related to "telephone cramming" - where unauthorized third-party charges appear on a person's phone bills. The unlawful practice was recently brought to the public's attention by Senator Jay Rockefeller (D-West Virginia). Sen. Rockefeller claimed the telephone industry has failed to prevent the practice and that Congress needs to pass laws to protect customers. According to Sen. Rockefellar, a one-year study by the Commerce, Science and Transportation Committee shows about $2 billion a year in "mystery fees" show up on customers' landline phone bills. Capretz & Associates along with the San Diego-based law offices of Casey Gerry Schenk Francavilla Blatt & Penfield, LLP, filed a class action lawsuit against the City of Chula Vista, California, demanding restitution as a result of continued collection of a controversial tax on cell phone calls. The lawsuit was filed in the San Diego Superior Court on behalf of Chula Vista residents seeking a refund of taxes arising from the City of Chula Vista’s improper collection and administration of a “Utility Users Tax" (UUT) collected on mobile phone use.
